Girl can claim all she wants. The insurance companies will come to a decision based upon the written report and the apparent circumstances shown therein.
I got caught up in a disagreement between two insurance companies one time, with myself as the innocent third party. Person in front of me slowed and turned left into a driveway. Just afterwards, there was a Mustang coming up the road in the opposite direction grinding down the side of my car and subsequently spinning out in the front yard of the vehicle that just turned in.
Both of their insurance companies admitted that I was not at fault, but wouldn't decide on whose fault (among the other two drivers) it was. That went on for several months. Meanwhile, my car remained pretty damaged (all the way down the left side) and the driver's door wouldn't open. I spent from April to October climbing in and out of the passenger side of the vehicle (thank goodness for a bench seat).
My folks finally approached our insurance company who told us to go ahead and fix it and they would get involved with the other two companies to be reimbursed. They didn't do that initially since I was a youthful driver (19 at the time) and claimed that my rates would increase until the thing was settled. They turned face when they found out six months after the fact that I was still not fixed.
