October 22, 2007 -- A 25-year-old aspiring boxer was gunned down yesterday after pointing his finger and pretending to shoot another motorist in Harlem, cops said.

The shooting occurred at 5:49 a.m. at East 120th Street and First Avenue.

Cops said the victim, Jayson Tirado, and the shooter exchanged angry words after both drivers were forced to exit the southbound lanes of the FDR Drive at 116th Street because of a motorcycle crash.

Police sources said the shooter drove ahead and, when Tirado caught up with him, words were exchanged again.

Tirado pointed his finger at the other driver and pretended to shoot him, the sources said.

The driver pulled out a real gun and shot Tirado in the torso, the sources said.

The shooter fled, and Tirado was rushed to Harlem Hospital, where he died.

Both cars pulled off the drive at 116th Street, investigators said, drove west to First Avenue and then north to 117th Street. At that point, the Nissan’s driver fired a gun, striking Mr. Tirado, the police said. Neither of Mr. Tirado’s passengers was injured, and no one in the Honda returned fire, the police said.

Mr. Tirado managed to continue driving north on First Avenue for three blocks. The Honda was found stopped in the intersection, as if Mr. Tirado were about to turn east on 120th Street, investigators said. It was unclear how many shots had been fired, but bullet holes were visible in one of the Honda’s rear passenger windows and its rear bumper.

The man in the Nissan fled, and no arrests had been made as of late yesterday, the police said. One of the passengers in Mr. Tirado’s car was interviewed by detectives; the other was intoxicated and was not immediately questioned, investigators said. An autopsy will be conducted on Mr. Tirado’s body.

Mr. Tirado lived in the Jacob Riis Houses, a large public housing complex off the F.D.R. Drive on the Lower East Side, with his companion and a young daughter, according to relatives. They said Mr. Tirado was unemployed, and they did not know why he was out early yesterday.

An off-duty NYPD narcotics officer is being questioned in connection with a road rage killing that took place in East Harlem Sunday morning, NewsChannel 4 has learned.

Investigators want to know if the off-duty officer was part of a "road rage" chase that began on FDR Drive and ended with the shooting death at East 120th Street.

The narcotics officer, a four-year veteran, is being questioned at the 25th Precinct, where charges are expected to be filed, sources said. Investigators said they want to know if the off-duty officer had been drinking and fled the scene after the shooting.

Off-duty police Officer Sean Sawyer made a startling revelation early Monday, admitting he approached a patrol car and fired the shot that killed a young father in an East Harlem road rage confrontation, police sources said.

The shooting, however, may have been an act of self-defense, with a friend of victim Jayson Tirado saying Tirado pretended he had a gun, fashioning one out of his thumb and forefinger and saying, "You want to see Mr. Ruger?" according to police sources.

"To the best of the information we have now, the victim who was shot made a reference to the fact that he had a gun, and then pointed his hand towards the driver of the other car," Police Commissioner Ray Kelly said.
