The people that were polled and thought he shouldn't be arrested, will be the same people on the Grand Jury that will choose to endict him or not.

If he is arrested, it will only be after a Grand Jury indictment. The police will probably send the case to the prosecutor with no recommendation and let the Grand Jury make the desicion.
